This Online Advertising Agreement (the “Agreement”) is between North County Access, LLC (“we” / “us”), publisher of the Paso Robles Daily News and our other news websites and email newsletters, and the advertiser who accepts it by completing payment (“you” / the “Advertiser”). It covers online ads you buy from us, such as display (box) ads, e-flyers, and promoted articles.
1. Your order
What you’re buying, its price, and how long it runs are shown at checkout or on your order. If anything on an order conflicts with this Agreement, this Agreement applies.
2. One-time ads
One-time ads (such as an e-flyer or a promoted article) are paid in full up front. Once the ad has been sent or published, it can’t be cancelled or refunded. If you cancel before it runs, we’ll refund your payment, less any design or writing work already done.
3. Fixed-term campaigns
Some campaigns run for a set length of time (for example, 3 or 12 months) at a set price. They are billed as shown at checkout and end when the term ends unless you choose to renew. A fixed-term campaign can’t be cancelled partway through for a refund.
4. Monthly subscriptions
Some ads (such as box ads on our news sites) are monthly subscriptions. They are billed in advance each month to your card or bank account on file and renew automatically each month. If your order has a minimum term, you’re committed for that minimum. After that, you can cancel any time with written notice (email is fine) before your next billing date, and your ad runs through the end of the month you’ve paid for.
5. Design and changes
We can design your ad at no extra charge unless your order says otherwise. Monthly ads include 1 free copy change per month. Extra changes may be charged at our current rate, which we’ll tell you before we make them.
6. Payment
Payments are processed securely through Stripe. If a payment fails, we may pause your ad until your account is current. Prices may change; we’ll give subscribers at least 30 days’ notice before a new price applies to them.
7. Your ad content
You confirm you have the right to use everything in your ad (text, images, logos, links) and that it’s truthful and legal. You’re responsible for your ad’s content. If someone makes a claim against us because of your ad, you’ll cover our resulting costs, including reasonable legal fees.
8. Our right to decline
We may decline or remove any ad at any time. If we remove an ad for a reason other than a breach of this Agreement, we’ll refund or credit the unused portion.
9. Placement and results
Display ads rotate with other ads, so your ad won’t appear on every page view. Unless your order guarantees a specific placement or number of views, placement is at our discretion. We don’t guarantee clicks, calls, leads, or sales.
10. Missed or incorrect ads
If your ad doesn’t run as ordered or runs with an error we caused, we’ll run it again or credit you for the affected period. That is the full extent of our responsibility for a missed or incorrect ad.
11. Limit of responsibility
Our total responsibility under this Agreement is limited to the amount you paid for the ad involved. We’re not responsible for indirect losses such as lost profits or lost business.
12. The basics
This Agreement is the whole agreement between us and replaces anything said before. Any changes must be in writing. This Agreement is governed by the laws of the State of California.
Acceptance
By completing payment, you agree to these terms. Completing payment has the same legal effect as signing this Agreement.
